Analysis Of Jasser Auda’s Legal Thoughts Regarding Maqashid Syariah And Its Relevance To Islamic Family Law Reform In Indonesia

Islamic family law is a law that continues to develop in accordance with the dynamics of community life, because the family is the smallest part of society. In the current modern era, including in Indonesia, various family problems have emerged that require more comprehensive solutions and legal arrangements, one of which is related to equal rights between men and women in the family which often causes conflict within the family. Jasser Auda as a contemporary Islamic legal thinker offers a system-based concept of maqashid sharia in responding to existing challenges. Therefore, this research aims to analyze Jasser Auda's legal thinking regarding maqashid sharia and its relevance to family law reform in Indonesia. This research is a library research type using secondary data sources consisting of primary, secondary and tertiary legal materials. The collected data was then analyzed using qualitative data analysis techniques. The results of this research conclude that in his maqashid theory, Jasser Auda put forward several features that must be fulfilled in the formulation of law using the maqashid sharia system approach, namely cognitive nature, wholeness, openness issues, interrelated hierarchies, multidimensionality (multi-dimensionality), and purpose (purposefulness). Linked to the reality of the current condition of family law in Indonesia, Jasser Auda's legal thoughts regarding the maqashid sharia system are very relevant to be implemented in formulating new laws that are more comprehensive in answering Islamic family law issues in Indonesia
