The Actualization of Maqashid Shariah for Gender Equalityin the Modern Era

Maqashid Shariah encompasses the protection of religion (hifzh ad-din), life (hifzh an-nafs), intellect (hifzh al-‘aql), lineage (hifzh an-nasl), and property (hifzh al-mal), which promote values of justice and welfare relevant to contemporary social contexts. By gaining a deeper understanding of the objectives of Shariah, the roles of women and men in Islam can be interpreted more broadly to support the realization of equal rights. In the modern era, gender issues face new challenges that demand adaptive approaches rooted in Shariah principles. This article focuses on how the actualization of Maqashid Shariah can guide the Muslim community in strengthening gender equality values in alignment with social, cultural, and global intellectual developments.The study explores how Maqashid Shariah can serve as a foundation for achieving justice and gender equality in dynamic social, economic, and political contexts. The researcher employs literature review and textual analysis of classical and contemporary scholars' perspectives, enabling this article to identify both the opportunities and challenges in actualizing Maqashid Shariah to ensure women's rights and encourage gender role balance in society. The study’s findings show that a progressive actualization of Maqashid Shariah can serve as a normative guide for advancing gender equality in harmony with Islamic values and the needs of modern society, despite several challenges that still need to be addressed
